These Terms of Service (“Terms”) govern your use of Pingbak, operated by Loud Star Ventures LLC (“Pingbak,” “we,” “us,” or “our”). By using Pingbak — as a business customer or as an end user receiving messages from a Pingbak-enabled business — you agree to these Terms.
Description of Service
Pingbak provides missed-call text-back and AI-assisted lead qualification for small service businesses. When a call to a Pingbak-enabled business goes unanswered, Pingbak automatically sends the caller a text message on behalf of that business to follow up and, where applicable, help schedule an appointment.
SMS Messaging Terms
- By calling a business that uses Pingbak, you consent to receive SMS messages from that business via the Pingbak platform related to your inquiry.
- Message frequency varies based on your conversation.
- Message and data rates may apply.
- Reply STOP at any time to opt out of further messages. Reply HELP for assistance.
- Carriers are not liable for delayed or undelivered messages.
For Pingbak Business Customers
If you are a business using Pingbak, you are responsible for the accuracy of the business information you provide, for ensuring you have the right to have Pingbak communicate with your customers on your behalf, and for complying with applicable laws regarding SMS marketing and communications (including TCPA) for your own use of the service.
Acceptable Use
You agree not to use Pingbak to send unlawful, harassing, or deceptive messages, or to use the service in any way that violates applicable law or carrier requirements.
Intellectual Property
Pingbak and its associated branding, software, and content are the property of Loud Star Ventures LLC and may not be copied or reproduced without permission.
Limitation of Liability
Pingbak is provided “as is.” To the maximum extent permitted by law, Loud Star Ventures LLC is not liable for indirect, incidental, or consequential damages arising from use of the service.
Termination
We may suspend or terminate access to Pingbak for violations of these Terms.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Changes to These Terms
We may update these Terms from time to time. Continued use of Pingbak after changes constitutes acceptance of the updated Terms.
